IMPORTANT – PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCEPTING THIS AGREEMENT, THEN SAVE THESE TERMS AND CONDITIONS AND STORE THEM ALONG WITH ALL CONFIRMATION EMAILS RELEVANT TO YOUR USE OF www.careerpassport.eu. WE WILL NOT FILE OUR CONTRACT WITH YOU AND SO YOU SHOULD SAVE IT OUT FOR YOUR RECORDS. THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE (AS SET OUT BELOW) AND WILL ONLY BE ACCESSIBLE VIA www.careerpassport.eu.
Definitions
In these terms and conditions, unless the context otherwise requires:

“Company” means Careerpassport;

"Website" means the www.careerpassport.eu website;

“Client” means any company, agency, partnership, business entity or organisation that is registered with Careerpassport and is using its services for recruitment purposes;

“User” means any visitor, registered or not, visiting or viewing the careerpassport.eu website or viewing and accessing information maintained within the Careerpassport system on any Client;

“Profile” means a record kept by Careerpassport, which record shall at all times be accessible to the Profile owner, which shows the Holder’s information submitted by the Holder. This information includes and is not exclusive to, personal information, work experiences, qualifications, uploaded files, languages, profile settings, preferences and submitted applications;

“Candidate” means any registered job seeker, over 16 years of age, owning or maintaining a Profile;

“Associated Company” means the careerpassport Clients which can view, or hold, the Profile information of the Profile they are associated with. The Candidate can add a Careerpassport Client to his list of Associated Companies by applying or registering with the Client. The Candidate may also, at any time, remove an Associated Company from his Profile.

“He” or other words importing the masculine gender shall include females;
General Terms
All usage of the Website and the information accepted by us are subject to these terms and conditions.
It is a condition of creating and holding a Profile with www.careerpassport.eu that Users agree to accept these terms and conditions. By registering, a User is deemed to have fully accepted and understood these terms and conditions. Attention is also drawn to the Careerpassport Privacy Policy, which describes how Careerpassport deals with, and protects the personal information of Candidates and Users. By accepting these Terms and Conditions, the Candidates is also acknowledging and accepting that policy.
If Careerpassport decides to change the terms and conditions, Careerpassport will post a notice on the Candidates profile home screen, and in other places deemed appropriate. Careerpassport reserves the right to modify these terms and conditions at any time, so please review it frequently. If Careerpassport makes material changes to this document, Candidates will notified by email, or by means of a notice on the homepage.
Should the Candidate, due to any possible changes, not wish to continue using the services of www.careerpassport.eu anymore, the Candidate can withdraw all the submitted information by sending an email to care@careerpassport.eu. It is noteworthy that, if the User decides to use the system subsequent to sending a total withdrawal of the Profile request, the User will be asked to re-register, as the data is completely removed from the database upon receiving the withdrawal request. Careerpassport therefore suggests that Users use this option if they wish to delete their Profile completely. It is recommended that Candidates use the current status field to indicate their current situation or the deactivate Profile option within their Profile if they wish to temporarily remove access and suspend their profile.
In the case of any disputes between the English language version of the Terms and Conditions and versions in other languages, the English language version shall prevail.
Website visitors are not required to register on our Website and such participation if elected by a User is at the User's sole option. Users are requested to register to create their Careerpassport Profile and to apply for any advertised job opportunities.
Profile Rules
Any prospective Candidate applying for a Profile must be at least 16 years old. It is up to the Candidate to ensure that they are of legal age to register in his own name in their country of residence. In any case the minimum acceptable age will be 16 years.
The Candidates registered on www.careerpassport.eu agree to abide by these Terms and Conditions at all times, and also confirm that they are:

not acting in the interests of any third party;

not utilising the Website for any criminal activity or activities;

not going to attempt to hack the Website or, to alter its code in any way;

not going to take part or organise any criminal actions against Careerpassport, its Clients, and its Candidates.
In the event of a Candidate not respecting one or more of the rules as mentioned above and in these terms and conditions, Careerpassport will close the Profile.
It is the responsibility of the Candidate to verify that when opening a Profile with careerpassport he is not breaking any laws in his jurisdiction.
In order to open a Profile with careerpassport, the prospective User must correctly fill in the Registration Form found on the Website and read and accept these Terms and Conditions as found on the Website.
The Candidate must submit the correct information during his registration. The Candidate also agrees to update this information should there be any changes to their personal data provided.
The Candidate is restricted to opening and maintaining only one Profile simultaneously, and one Profile should be opened per person.
Careerpassport may, at its own discretion and without having to provide any justification, refuse to open a Profile or close an existing Profile.
During the registration process the Candidates will be able to insert their email address to be used as a unique username and a password. This password may be changed by the Candidate at any time.
The Candidate must keep the Password secret at all times. In this respect, Careerpassport advises the Candidates not to write down their password in a way that can be easily found or used. Careerpassport also advises Candidates not to leave their computers unattended when logged in so that they can avoid anyone using their account without their consent. Careerpassport also advises the Account Holders to compile a password which contains upper case and lower case alphabetical characters and numbers and to have a minimum length of 6 (six) characters.
If an action is done, using the email address and password of a Candidate, it will be considered to have been made by the Candidate and therefore will be accepted and deemed valid. Careerpassport retains the right to examine and confirm the identity of its Candidates.
The Candidate agrees that we may process, use and record personal information which is provided in connection with the registration and that such personal data may be recorded by us. For Candidate protection purposes, any telephone calls or emails to our Customer Service may be recorded and monitored.
Candidates have the right to close a Profile at any time and should indicate their desire to close their account by deactivating their Profile.
Complaints handling
If a Candidate has a dispute, query or problem, he must contact careerpassport directly within 48 hours of the event.
Should the candidate at any time feel that he is dissatisfied with our Website, customer service, or feel in any way that careerpassport has not lived up to his expectations the Candidate may send a complaint to care@careerpassport.eu. This will be passed immediately on to the management. Careerpassport will handle the complaint in the shortest possible time.
Privacy
Careerpassport has notified the Commissioner for Data Protection that it is processing personal data in accordance with the Data Protection Act, 2001 of the Laws of Malta. Careerpassport will only process Candidate personal data for the purposes for which it collected it, namely to assist the Candidate in identifying career opportunities and in accordance to the privacy policy available from the Website. The Candidate’s Careerpassport Profile, information and documentation can only viewed by the Associated Companies / Agencies that the Candidate may choose to allow. Careerpassport does not share any Candidates data with any other parties outside the Company without your consent; however, at times we may be required by law or legal process to disclose your personal information. We may also disclose information about the Candidate if we believe that disclosure is necessary for the public interest.
Copyright
The User understands that the graphic elements of www.careerpassport.eu are the trademarks, service marks and trade names of Careerpassport, or others and the User has no rights to such items, nor any other items, graphics, text, concepts or methodologies contained therein.
Liability
Careerpassport is only liable for gross negligence or deliberate actions carried out by its management or employees.
Careerpassport is not responsible for the services, pages or contents of websites to which links may be provided from time to time from the www.careerpassport.eu Website.
Careerpassport is not responsible for the services, pages or content of websites of Clients using Careerpassport system and displaying its contents on their own website. Careerpassport is only responsible for the services and data supplied to Clients through their web services. It is noteworthy that, these terms and conditions shall only govern the relationship and any information transfer between the Candidate and Careerpassport. Users should be aware of any Client’s terms and conditions when using the Client website to access Careerpassport
Careerpassport is not responsible for any consequences resulting from major incidents such as any strike, terrorist activities, political crisis, war, and saturation of the telecommunication networks, natural catastrophe; which could lead to a total or partial reduction, to the access to its services, on Internet or by phone.
Careerpassport is not responsible for any actions of Agencies or Companies making use of the Careerpassport Website and software. Agencies and Companies are instructed and bound, by the terms of business, to acquire the Candidate’s approval and consent before disclosing Candidates details and Profile to third party, however Careerpassport shall not be held liable if Candidate personal information is shared illegally by Agencies and Companies using the system.
Careerpassport is not to be held responsible for the consequences caused by the breakdown of any device or software, directly managed or outsourced, which could lead to a total or partial reduction to the access of its Services, via Internet or by phone.
Should one or more term or condition of this agreement be declared void by a recognised Court of Justice, then the remaining Terms & Conditions would retain their validity. These Terms & Conditions represent the whole of the agreement between Careerpassport and the Candidate, and replace any previous written or verbal agreement, communicated by Careerpassport.
Careerpassport does not accept any liability whatsoever for damage to a Candidate or a third party which arises directly or indirectly from a mistake, misprint, malfunction of software on the Careerpassport Website or that of any of its Clients or partners.
Governing Law
The agreement and all relations, disputes and other matters arising hereunder shall be governed by, and construed in accordance with, the Laws of Malta.
Any dispute, controversy or claim arising out of or relating to this Agreement, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the rules of the Malta Arbitration Centre as at present in force. The appointing authority and administrator shall be the Malta Arbitration Centre. The number of arbitrators shall be one. The place of arbitration shall be Malta. The language to be used in the arbitral proceedings shall be English. Arbitration in terms of this Clause shall constitute the sole and exclusive remedy for the resolution of disputes, controversies of claims arising out of or relating to this agreement, or the breach, termination or invalidity thereof.
Duration and Termination
These Terms and Conditions shall remain in effect indefinitely unless otherwise terminated by either Party by giving one month’s prior written notice to the other Party. Careerpassport shall be entitled by notice in writing to terminate these Terms and Conditions and consequently terminate the relationship with the Candidate upon breach of any terms and conditions hereof.
